These Website Terms of Use ("Terms") govern your access to and use of https://www.gorillanetting.com (the "Site") operated by Gorilla Netting LLC ("Gorilla Netting," "we," "us," or "our").

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms are website terms only. They are not a construction contract, statement of work, or installation agreement. Project scope, price, schedule, warranty, insurance, and site conditions are governed only by a written proposal and signed agreement between you and Gorilla Netting LLC (see Section 5 and our Services Terms Summary).

1. Who We Are; Trade Names (DBAs)

References on the Site to those names mean Gorilla Netting LLC doing business under that trade name.

Separate company - product shop: Online product sales at https://shop.gorillanetting.com are operated by Gorilla Netting & Equipment LLC, which is not the operator of this services Site. Shop purchases are subject to that entity's terms and policies, not these Terms.

2. Eligibility and Acceptable Use

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

Violate any applicable law or third-party right;
Attempt to gain unauthorized access to the Site, servers, or related systems;
Interfere with or disrupt the Site (including denial-of-service attacks, scraping that impairs performance, or introducing malware);
Use automated means to access the Site in a manner that overloads or harms our systems, except ordinary search-engine indexing;
Misrepresent your identity or affiliation when submitting forms;
Submit unlawful, defamatory, or infringing content; or
Use Site content to build a competing dataset or to train machine-learning models in a way that violates our intellectual-property rights, except as permitted by applicable law.

We may suspend or block access for conduct we reasonably believe violates these Terms.

3. Informational Nature of the Site; No Reliance on Quotes Shown Online

Content on the Site, including descriptions of netting systems, pole setting, sports lighting, project galleries, guides, cost ranges, timelines, and marketing statements, is for general information only.

Site content is not an offer, bid, or binding quote.
Online calculators, budget ranges, or "get a quote" flows (if any) are estimates or intake tools, not contracts.
Specifications, lead times, and availability change with materials, engineering, permitting, and site conditions.

Do not rely on Site content as a substitute for a written proposal. Only a written proposal issued by Gorilla Netting LLC and a signed agreement define price, scope, and obligations.

4. Intellectual Property

Unless otherwise noted, the Site and its contents, including text, graphics, logos, photographs, videos, layout, and the "Built Gorilla Strong.®" brand elements, are owned by Gorilla Netting LLC or its licensors and are protected by U.S. and international intellectual-property laws.

You may:

View and temporarily download materials for your personal or internal business evaluation of our services; and
Share links to public Site pages.

You may not, without prior written permission:

Copy, mirror, republish, or commercially exploit Site content;
Remove proprietary notices; or
Use our trademarks (including Gorilla Netting, our DBAs, or Built Gorilla Strong.®) in a way that suggests endorsement or affiliation we have not approved.

Project photos may depict customer facilities; trademarks of customers or third parties remain their property and do not imply endorsement beyond what is stated.

5. Proposals, Contracts, and Services

If you request a quote or engage us:

We may request site information, drawings, or a site visit;
Any proposal we issue is subject to its stated assumptions, exclusions, and expiration date;
A signed agreement (and any incorporated exhibits, drawings, and change orders) controls over these Terms and over marketing language on the Site;
Deposits, payment schedules, change orders, delays, materials, warranty, and insurance are addressed in that agreement (see also our Services Terms Summary and Project Materials & Changes pages).

Nothing on the Site creates a partnership, joint venture, or employment relationship between you and Gorilla Netting.

6. User Submissions

If you submit information, feedback, photos, drawings, or other materials through the Site or by email ("Submissions"):

You represent that you have the right to provide them and that they do not infringe others' rights;
You grant Gorilla Netting LLC a non-exclusive, worldwide, royalty-free license to use Submissions to respond to you, prepare proposals, perform services, and improve our offerings;
Submissions that contain personal information are also handled under our Privacy Policy;
Do not submit confidential third-party information unless you are authorized and have marked it appropriately. Sensitive project data may require a separate NDA on a case-by-case basis.

Unsolicited ideas: If you send creative ideas outside a formal engagement, we may already be working on similar concepts and are not obligated to treat them as confidential or to compensate you, except as required by a separate written agreement or applicable law.

7. Third-Party Links and Embeds

The Site may link to third-party sites (including shop.gorillanetting.com, social media, maps, or video embeds). We do not control those sites and are not responsible for their content, privacy practices, or availability. Your use of third-party services is at your own risk and subject to their terms.

8. Marketing Claims; Limited Warranty Disclaimer on the Site

The Site may state a marketing claim such as a "5-Year Full Warranty on Installations."

Important: Any warranty is a limited warranty whose scope, duration, exclusions, transferability, and remedies are defined only in the applicable written contract and warranty documents for your project, not by website headlines. Labor, materials, manufacturer warranties, misuse, weather events, third-party damage, and maintenance obligations may all affect coverage. Until a contract is signed, no warranty is created by browsing the Site.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that content is complete, accurate, or current.

Some jurisdictions do not allow certain disclaimer limitations; in those jurisdictions, our liability is limited to the fullest extent permitted.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GORILLA NETTING LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR RELIANCE ON SITE CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SITE UNDER THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

This Section limits liability for website use only. Liability arising from contracted installation or other services is governed exclusively by the signed project agreement (which may include different caps, insurance, and indemnity terms).

Some jurisdictions do not allow limitation of certain damages; in those cases, our liability is limited to the fullest extent permitted by law.

11. Indemnity

You agree to defend, indemnify, and hold harmless Gorilla Netting LLC and its officers, members, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your misuse of the Site; (b) your violation of these Terms; or (c) your Submissions, including claims that Submissions infringe third-party rights, except to the extent caused by our willful misconduct.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles that would require application of another jurisdiction's laws.

Exclusive venue for disputes arising out of or relating to these Terms or the Site shall be the state or federal courts located in Florida, and you consent to personal jurisdiction there.

Mandatory consumer protections (if any apply) are not waived where waiver is prohibited.

13. Changes

We may revise these Terms by posting an updated version on the Site with a new effective date. Continued use after posting constitutes acceptance of the revised Terms, except where additional consent is required by law. For material changes affecting contracted customers, the signed agreement still controls the project relationship.

14. Miscellaneous

Entire agreement (website): These Terms and our Privacy Policy are the entire agreement regarding Site use (not regarding construction services).
Severability: If any provision is unenforceable, the remainder stays in effect.
No waiver: Failure to enforce a provision is not a waiver.
Assignment: You may not assign these Terms without our consent; we may assign them in connection with a corporate transaction.
Headings: For convenience only.
